Guide to the Provisions of Insurance Protection Extension to Qatari Citizens Working in GCC Member States

 

Introduction 
In implementation of legislation No. (4) dated 2007, approving the Unified Law of Insurance Protection Extension to GCC Member State Citizens Working in other GCC Member States, and pursuant to Article (6/1) of the said Law, the employer guide was prepared in order to set forth the practical procedures for the implementation of the Unified Law of Insurance Protection Extension. Moreover, the provisions of legislation No. (24) dated 2002, regarding retirement and pensions which was amended by legislation No. (33) dated 2004, shall be applied to Qatari citizens working in any GCC Member State.

A. Coverage Terms: 
1. The worker/employee shall be a Qatari citizen.
2. The worker/employee shall be working with a government agency, public authority or organization, joint venture company, or a body covered pursuant to a decision of the Council of Ministers.

B. Categories Excepted: 
The following categories are excepted from coverage:
1. Retirees of the State of Qatar before 06/03/2003. 
2. Employees or workers covered under a private retirement and pension scheme offering better benefits.

C. Date of Application (01/01/2007):
Pursuant to Article (3) of legislation No. (4) dated 2007, approving the Unified Law of Insurance Protection Extension to GCC Member State Citizens Working in other GCC Member States, the application of this Law shall be effective from 01/01/2007.

1. The employer shall register the Qatari citizen upon employment in any GCC Member State, provided that the citizen meets the provisions set forth in the scope of application, attaching the following documents:

a. Registration form which shall be completed and approved in the work location state. 
b. Copy of the National ID Card.

2. The employer shall send these documents to the civil retirement/social insurance agency of the work location state, which, in turn, certifies and sends them to Qatar's General Retirement and Pension Authority. The registration is processed in accordance with the applicable procedures in the State of Qatar. 
3. Employers shall be notified by the social insurance/civil retirement agencies of the status of registration of a Qatari citizen, providing reasons for disapproved registration. 
4. On a monthly basis, the employer shall provide the civil retirement/social insurance agency of the work location state with modifications to employee basic data as well as names of new and terminated insured persons. Such modifications and names are then sent to Qatar's General Retirement and Pension Authority.

1. The contributory wage is the last basic wage plus the social allowance, if any.
2. The employee/worker share is 5% of the contributory wage. 
3. The employer share is 10% of the contributory wage; or the rate applied by the retirement scheme of the work location state if the employer share is less than 10%.
4. If the employer share is less than 10%, the employee/worker shall bear the difference between the two rates. 
5. The employer shall monthly deduct the rates referred to, plus the difference between the rate (10%) and the employer share, if any. These amounts and the employer share shall be deposited in the bank account specified by Qatar's General Retirement and Pension Authority. 
6. Contributions shall be paid in local currency of the work location state during the dates specified by the state's retirement Law. 
7. The employer shall notify Qatar's General Retirement and Pension Authority on a monthly basis about the details of contribution amounts deposited in the bank account. 
8. Penalties set forth in the retirement law of the work location state shall be applied to the employer in case of delay in payment of contributions. 
9. The civil retirement/social insurance agency of the work location state shall follow-up the process of collecting contributions in due time.

The contribution shall be discontinued upon failure to meet the above-mentioned provisions of the scope of application, or when the service is terminated. In such cases, the following should be taken:
1. The employer shall notify the civil retirement/social insurance agency of the work location state if the contribution or service of Qatari employee/worker was discontinued or terminated by virtue of Service Termination Form. Such notifications shall be within the period determined in the Law of the work location state. Such agency shall, in turn, notify Qatar's General Retirement and Pension Authority. 
2. The employer shall notify the civil retirement/social insurance agency of the work location state in case of disability or death of a Qatari employee/worker covered under the Unified Law of Insurance Protection Extension. The latter shall complete the required medical reports and certificates that prove disability or death, and send them to Qatar's General Retirement and Pension Authority to take necessary procedures for the settlement of employee/worker entitlements.
3. In case a Qatari employee/worker is reported missing, the employer shall prove the case in accordance with the procedures applicable in the work location state. The documents proving the missing incident shall be sent to the civil retirement/social insurance agency of the work location state, which in turn approves and sends them to Qatar's General Retirement and Pension Authority.
4. If the service of employee/worker is terminated as a result of job cancellation or non-disciplinary dismissal from government agencies or public authorities and organizations, a copy of job cancellation or non-disciplinary dismissal document shall be submitted.

Application of this Law shall be limited to insuring old-age, disability and death. This shall not preclude insurance on injuries and occupational diseases for the employee/worker in accordance with the applicable provisions applicable in the work location state.
